We will be referencing Tennessee Code Annotated § 68-10-104, which authorizes health officers and physicians to examine, diagnose, and treat minors for sexually transmitted infections (STIs/STDs) without the knowledge or consent of parents or guardians. This law, often cited in public health protocols, protects providers from liability while ensuring minors can receive confidential care.
Key Aspects of T.C.A. § 68-10-104:
- Scope: Applies to the examination, diagnosis, and treatment of STIs/STDs in minors.
- Confidentiality: Services can be provided without parental or Department of Children’s Services (DCS) consent.
- Liability Protection: Health officers and physicians incur no civil or criminal liability for such treatment, except in cases of negligence.
- Applicability: Applies to services provided through local health departments and, by extension, private physicians.
This statute is designed to encourage, and facilitate prompt treatment for, infections in youth by removing the barrier of mandatory parental notification.
